Agnostic Rhythm Terms of Service

Welcome to Agnostic Rhythm, a service provided by Agnostic Networks ("we," "our," or "us"). These Terms of Service ("Terms") govern your use of the Agnostic Rhythm platform (the "Service"). By accessing or using the Service, you agree to be bound by these Terms. If you do not agree to these Terms, you may not access or use the Service.

1. Service Overview

Agnostic Rhythm is a communication-first platform designed to enhance client engagement and streamline field service operations. Our Service includes omni-channel messaging, client portals, CRM synchronization capabilities, and real-time support features. Agnostic Rhythm can operate independently or integrate with select third-party platforms, such as Jobber, to extend functionality.

2. Eligibility

You must be at least 18 years old to use the Service. By agreeing to these Terms, you represent and warrant that you have the authority to bind the organization you represent.

3. Account Registration and Security

You are responsible for:

• Providing accurate, current registration information.
• Maintaining the confidentiality of your account credentials.
• All activities that occur under your account.

You must promptly notify us of any unauthorized access or security breach.

4. Use of the Service

You agree to use the Service only for lawful purposes and in accordance with these Terms. You may not:

• Use the Service to transmit unlawful, harassing, or abusive content.
• Interfere with or disrupt the Service’s operation or security.
• Reverse engineer, decompile, or attempt to extract source code.
• Use the Service to send unsolicited communications (spam).

5. Fees and Payment

Use of Agnostic Rhythm is subject to applicable subscription fees as outlined at the time of purchase. Fees are billed in advance and are non-refundable except as required by law. Failure to pay fees may result in suspension or termination of your access to the Service.

By using the Service, you consent to the collection and use of information as described in our Privacy Policy. You retain ownership of your customer data. We access and process your data solely to deliver and improve the Service.

7. Third-Party Integrations

Agnostic Rhythm may integrate with third-party platforms, such as Jobber, for enhanced functionality. You acknowledge that:

• Access to third-party platforms may be governed by their separate terms and conditions.
• Disruptions or limitations in third-party services may impact related features within Agnostic Rhythm.
• We are not responsible for third-party service availability or changes.

We reserve the right to modify, enhance, or discontinue features of the Service at any time with or without notice. We are not liable for any modification, suspension, or discontinuation.

9. Termination

You may terminate your use of the Service at any time. We reserve the right to suspend or terminate your access if you violate these Terms or if continued use could harm our business or users. Upon termination, your right to access the Service will cease immediately.

10. Disclaimer of Warranties

The Service is provided "as is" and "as available" without warranties of any kind, express or implied. We do not guarantee:

To the maximum extent permitted by law, Agnostic Networks is not liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, revenue, or data arising from your use of the Service. Our total liability is limited to the amount paid by you for the Service during the 12 months preceding the claim.

You agree to defend, indemnify, and hold harmless Agnostic Networks and its affiliates from any claims, damages, liabilities, and expenses arising out of your use of the Service or your violation of these Terms.

These Terms are governed by the laws of the State of California, United States, without regard to its conflict of laws principles.
